Compulsory enrolment and the right to education

Abstract

This article seeks to reflect on the mandatory enrollment in preschool and elementary school as consequences of the right education. Through bibliographic and documentary research, with a qualitative approach, it analyzes laws nº 12.796/2013 and nº 11.274/2006 that provide for compulsory enrollment in preschool, at 4 years, and elementary school, at 6 years of age. In the Federal Constitution of 1988, education is positive as a social right, which created legal and institutional instruments that enable its enforceability. The laws aimed at ensuring enrollment, through compulsory, in basic education express, on the one hand, the social demand for public school and, on the other hand, express the focused character of social policy in order to manage poverty levels.
